Foreign Buyer Reviewing Property Ownership Documents In A Modern Muscat Residence

Usufruct vs Freehold Oman: What Foreign Buyers Actually Receive in an ITC

At a glance

Usufruct vs freehold Oman is not simply a choice between two labels. Only outside ITC zones, usufruct is granted for an initial 50 years, renewable up to a maximum of 99 years — this does not apply to freehold units inside an ITC; in an ITC, a non-Omani buyer can acquire a registered residential unit under the ITC ownership regime. The decisive document is the registered title and the exact rights stated in the sale contract.

For an international buyer, the practical question is not whether a brochure uses the word “freehold”. It is whether the unit sits inside a licensed Integrated Tourism Complex, what is registered in the buyer’s name, and which obligations remain attached to the property. In Oman, that legal distinction shapes resale, inheritance planning, residence eligibility and the cost of completing a transaction.

Freehold and usufruct: the core legal difference

What freehold means in an ITC

Freehold ownership gives the buyer a registered ownership interest in the specific residential unit or plot sold under the ITC framework. Royal Decree No. 12/2006 allows Omani and non-Omani natural and legal persons to own land or built units in licensed Integrated Tourism Complexes for accommodation or investment, subject to the applicable rules and approvals.

For a foreign individual, an ITC is therefore the key legal setting. The Ministry of Housing and Urban Planning states that foreign nationals may purchase land only within ITCs. A property marketed as freehold should still be checked against its title deed, unit description, master-plan approvals and sale documentation rather than accepted as a marketing term alone.

What usufruct means outside an ITC

Usufruct is a time-limited right to use and benefit from property rather than perpetual ownership. Under Ministerial Decision No. 357/2020, which applies only outside ITC zones, usufruct is granted for an initial 50 years, renewable up to a maximum of 99 years, for qualifying buildings of at least four storeys, subject to residency, value and other conditions. It is not the same legal route as buying a registered ITC unit.

The remaining duration matters. A 99-year right and a shorter remaining term can have very different resale and financing implications. Before signing, ask for the commencement date, expiry date, permitted use, transfer rules and renewal mechanism in writing.

What a foreign buyer receives in an ITC project

A registered right, not an unrestricted right to any land in Oman

An ITC purchase does not create a blanket right to buy any residential land in Oman. It gives the buyer the right attached to the specific registered property within the licensed complex. The ITC rules, the developer’s approved regulations and the property documents remain relevant after completion.

This is why unit-level due diligence matters. Confirm the legal description, unit boundaries, common-area arrangements, permitted use, service-charge obligations and whether the purchase is off-plan or completed. If the property is off-plan, the sale and payment documentation should identify the unit clearly and explain the handover standard.

Residence eligibility is separate from ownership

Ownership in an ITC can support an application for a property-owner residence visa, but the visa is a separate government process. The Royal Oman Police service provides a two-year residence visa for owners of residential units in ITCs, with a 50 OMR issuance fee. The applicant must be outside Oman when applying and must not hold another valid visa at that time.

That distinction is practical: ownership registration should be treated as the property transaction, while residency is a later application with its own documents. Spouses and first-degree relatives may use a separate joining service, subject to its conditions.

Worth knowing

For a non-Omani buyer, the purchase registration fee is 3% of the property value. The standard fixed charges listed for the ownership service are 5 OMR for the application, 25 OMR for the non-Omani sale form, 10 OMR for the title deed and 2 OMR for the contract.

Transaction costs and obligations to separate

Registration, VAT and ongoing charges

Do not merge all 3% charges into one line item. The 3% property registration fee is charged on the purchase value for foreign buyers. It is different from Muscat’s 3% municipal rental fee, which is calculated as monthly rent multiplied by contract term and applies to a rental contract rather than a sale.

VAT is another separate item. The first sale of residential real estate is subject to 5% VAT, while a residential resale and residential rent are VAT-exempt. In a developer sale, request a payment schedule that shows VAT separately from the price, registration fees and any service charges.

At AIDA in Yiti, buyer cost planning should also include a service charge that varies by collection, from about 4 OMR per m² of built-up area a year (Halo Villas) to 12 OMR per m² a year (Marriott Residences), alongside the contractual price and statutory fees. The exact charge, billing method and inclusions must be confirmed in the documents for the specific unit.

Developer documents still matter after the legal label

A typical buyer planning permanent life in Muscat benefits more from reviewing the full cost schedule and project rules than from comparing headline prices alone. We recommend testing the budget against annual service charges, 5% VAT on the first residential sale and the 3% registration fee before reserving a unit.

For buyers comparing villas, Aida Oceana Villas is a useful starting point for the project context. Individual collections have their own contractual terms: Trump Cliff Villas are scheduled for handover in Q4 2028, while Halo Villas are scheduled for Q4 2029. The exact handover date must always be fixed in the contract for the specific property.

Watch out for

Do not assume that every foreign-owned property in Oman is freehold or that every ITC purchase grants an automatic residence visa. Check the registered ownership form, the project’s ITC status and the separate visa conditions before relying on either outcome.

Due diligence questions before you reserve

Ask for the legal chain, not just the sales brochure

Request the draft sale and purchase agreement, the project’s ownership framework, payment schedule and a clear explanation of what will appear on the title deed. For completed units, compare the title deed and cadastral information with the unit you inspected. For off-plan units, check how the contract identifies the future unit and when registration takes place.

Also ask whether there are restrictions on alterations, short-term use, leasing, transfer before handover or common-area access. These points affect the day-to-day value of ownership even when the legal interest is freehold.

Use the right decision rule

🏠
Long-term resident
2-year owner visa route
Prioritise an ITC unit with clear title documentation, then assess the separate residence-visa application and its 50 OMR issuance fee.
📈
Investment buyer
3% registration fee
Model the acquisition cost with the registration fee, 5% VAT on a first residential sale and project-specific service charges.
📜
Usufruct buyer
Outside ITC: 50–99 years
Focus on the remaining term, permitted use and transfer conditions. The term left on the right is central to value and exit planning.

The concise rule is this: choose an ITC freehold purchase when you want a registered ownership route available to foreign buyers; consider usufruct only after you understand the remaining term and its specific restrictions. In both cases, the signed contract and registered documents define what you actually acquire.
